Withdrawal form

§1. Definitions

 

- Store / Service – an online sales platform available at the address mistykaistnienia.pl

- Client / Buyer – a natural person (consumer or a person conducting a sole proprietorship in a non-professional capacity), a legal person, or an organizational unit purchasing from the Store.

- Consumer-entrepreneur – a natural person running a business who makes a purchase not directly related to their professional activity (Article 38a of the Consumer Rights Act).

- Goods / Product – a movable item or digital content available in the Store.

- Agreement – a distance sales agreement concluded between the Seller and the Client under the terms set out in this Regulation.

 

§2. Scope of services and terms of provision

 

- The Seller conducts the sale of Goods and provides the following services:

a) creation and maintenance of the Client's account,

b) sending a newsletter (upon consent),

c) product review system.

- Services are provided electronically within the meaning of the Act of July 18, 2002 on the provision of services by electronic means.

- The condition for using the Store is:

- a device with Internet access,

- a web browser (Chrome, Firefox, Safari, Edge) no older than 2 years,

- an active email account,

- enabled support for cookies and JavaScript.

 

§3. Placing an order and the moment of concluding the Agreement

 

- The Client selects the Goods, completes the order form, and confirms by clicking the “Order and pay” button; this action signifies an obligation to pay.

- After placing the order, the Client receives an automatic summary. The Agreement is deemed concluded at the moment the Seller sends a confirmation of order acceptance on a durable medium (email).

- The Seller makes the Regulation available in a form that allows for its download, preservation, and printing.

 

§4. Payments

 

- Available payment methods:

- Payment cards: Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro

- Online transfers, BLIK, electronic wallets, cash on delivery, installments/postponed payment (if available).

- The entity providing online payment services is Autopay S.A.

- In the case of advance payment, the Client must make the payment within 3 business days; failure to pay results in order cancellation.

- The execution of an order paid by card occurs after the transaction has been positively authorized by the operator.

- Refunds for card transactions are made to the bank account associated with the Client's card or in the same manner as the payment was made unless the Client agrees to another form of refund that does not incur costs.

 

§5. Delivery

 

- Delivery methods, costs, and times (example – adjust to the current offer):

- Delivery outside Poland may be subject to additional charges and restrictions resulting from the export regulations of the respective country; information is presented during the order placement.

- The risk of accidental loss or damage to the Goods passes to the Client at the moment of their release.

 

§6. Right of withdrawal from the Agreement

 

- The Client (including Consumer-entrepreneur) may withdraw from the Agreement within 14 days:

a) from the receipt of the Goods,

- To meet the deadline, it is sufficient to send a statement before its expiry. The withdrawal form template is an annex to the Regulation.

- Refund of payment occurs immediately, no later than 14 days from receiving the statement; the Seller may withhold the refund until the Goods are returned or proof of their return is provided.

- The Client bears the direct costs of returning the Goods.

- The right of withdrawal does not apply in cases such as:

- Goods produced according to the Client's specifications or serving to meet their individual needs,

- Goods subject to rapid spoilage or with a short shelf life,

- Digital content delivered in a non-material way.

 

§7. Warranty, guarantee, and complaints

 

- The Seller is liable to the Client for defects in the Goods based on Article 556 and subsequent articles of the Civil Code (warranty).

- Complaints should be submitted in writing or via email to the address specified in §1; it is recommended to include a description of the defect, the date of its detection, and the Client's requests.

- The Seller will respond to the complaint within 14 days. Lack of response within this period means the complaint is accepted.

- If the Goods are covered by the manufacturer's warranty, the terms are specified in the warranty card.

 

§8. Rights and obligations of the parties

 

- The Client agrees to use the Store in accordance with the law, the Regulation, and good manners.

- The Seller has the right to suspend the execution of the order in case of violation by the Client of the regulations or these Regulations.

- The Seller delivers Goods free from defects, except for defects indicated in the offer.

 

§9. Personal data

 

- The administrator of personal data is the Seller.

- Data is processed for the purpose of order fulfillment, account management, pursuing claims, and – with consent – for marketing of own services.

- Legal bases for processing: Article 6(1)(b), (c), and (f) of the GDPR. Details can be found in the Privacy Policy available in the Store.

 

§10. Final provisions

 

- The Regulation is governed by Polish law.

- In matters not regulated, the provisions of the Civil Code, the Consumer Rights Act, and the Act on the Provision of Services by Electronic Means apply.

- The Seller reserves the right to change the Regulation for important legal or technical reasons; Clients will be informed of changes at least 7 days before they come into effect.
